Campaign Official Terms & Conditions

Please read these Terms and Conditions carefully before you participate in this Lotus’s Lazada and Shopee Official Stores - Aptamil™ KID & Aptamil™ KID C-SynB : Stand A Chance to Win Dyson AirStrait (“Campaign”) organized by Danone Specialized Nutrition (Malaysia) Sdn Bhd (“Organizer”). By participating in this Campaign, you ("Participant") are deemed to have accepted these Terms and Conditions and that you agree to abide by them. If you do not agree to these Terms and Conditions, please refrain from participating in this Campaign.

CAMPAIGN PERIOD  

This Campaign is set on 01 December 2024 (00:00:00 a.m.) and ends on 31 December 2024 (23:59:59 p.m.) (“Campaign Period”).

Last receipt submission date is on 31 December 2024 (23:59:59 p.m.). The Organizer reserves the right, at its absolute discretion, to vary, postpone, re-schedule and/or extend the Campaign Period and/or cancel/terminate the Campaign at any time without prior notice.

PARTICIPATION CRITERIA

  1. This Campaign is only open to Participants who are Malaysian citizens with a valid registered Malaysian mobile and address, aged eighteen (18) years of age or older in 2024.
  2. Purchase of any Participating Products below are required to take part in this Campaign.
    i.  Aptamil™ KID Core (600g, 1.2kg, 1.8kg)
    ii. Aptamil™ KID C-SynB 600g
  3. Employees of Danone Specialized Nutrition and their immediate families (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) or those living in the same household (whether or not related) and their respective parents, affiliates, subsidiaries, prize suppliers, distributors and advertising and promotion agencies are not eligible to participate in or claim any winnings under the terms of this Campaign.        

SUBMISSION STEPS

  1. To participate in this Campaign, Participants must purchase the participating products in Lotus’s Lazada Official Store (https://www.lazada.com.my/shop/lotuss-official-store/) or Lotus’s Shopee Official Store (https://shopee.com.my/lotuss.fbs) only during the Campaign Period. Any purchases made in any other online stores that is not the above mentioned Lotus’s Official Store are not entitled for participations.
  2. Participations will be automatically registered from Lotus’s Official Store on Lazada Platform (https://www.lazada.com.my/shop/lotuss-official-store/) and Shopee Platform (https://shopee.com.my/lotuss.fbs) upon purchasing of participating products within the Campaign Period with completed delivery of purchased products.
  3. Participants are to screenshot of the order details and it must contain the order ID and indicate that the order is paid, delivered and completed. The Participant must be able to provide the Organiser with the mentioned screenshot if contacted. 
  4. How to participate:
    a) Each receipt ( Proof of Purchase ) can be used once only to participate in the Campaign.
    b) Only highest amount of purchases of participating products in 1 ( ONE) TRANSACTION ONLINE ORDER will be selected to achieve Top Spender within the Campaign Period.
    c) If you are shortlisted winner, appointed agency will contact the selected shortlisted winner through WhatsApp to answer a question : ‘’AptamilTM KID is my brand of choice because…..” ( in less than 20 words ).
  5. Winner Selections:
    a) 2 X Top Spender Winners will be selected based on the highest amount purchase of participating product at Lotus’s Lazada and Shopee Official Store during the Campaign Period as the Top Spender. 
    b) If the number of winners (Top Spenders) exceed the prize allocation, the Top Spenders with the most creative answer to the question will be eligible for the prize.
    c) Only highest amount of purchases of participating products in 1 ( ONE) TRANSACTION ONLINE ORDER will be selected to achieve Top Spender within the Campaign Period.
    d) Any late submission will be disqualified.
    e) Each Participant can only win one (1) prize throughout the Campaign Period ("Prize").
  6. Total Prizes:
    a) Dyson AirStrait x 2 units
  7. Delivery of Prizes:
    a) Prizes will be delivered to the address provided by the Participant. It is the responsibility of the Participant to provide a correct and valid address.
    b) This Campaign is valid for Malaysia addresses only.
    c) Any returned and unredeemed items will be forfeited. 
    d) Prizes will be delivered within 8 – 12 weeks from 15th January 2025. 
    e) The Organizer reserves the rights to extend the timelines stated under this clause owing to reasons beyond the Organizer’s control.
    f) Prizes are not transferable, exchangeable, and redeemable for cash.
  8. The Organizer is not responsible nor liable to the participants for any error, omission, interruption, deletion, defect, delay, misdirect, failure in operation or transmission, communications line failure, theft or destruction, unauthorized access to, or alternation of, user or member communications, or any problems or technical malfunction or glitches of any telephone network or lines, the website, computer online systems, servers or providers, computer equipment, system, apparatus, software, failure of receipt of entry on account of technical problems or traffic congestion on the internet and/or telecommunication services. 
  9. If for any reason (e.g., no reply, telephone no. provided not in service, no network connection etc.), the shortlisted winners cannot be reached after three (3) attempts, the Prize will be forfeited. The Organizer shall not be held liable in the event the winner cannot be contacted for whatever reasons.
  10. The Organizer shall have absolute discretion and reserves the right to select an alternate winner who will be subject to the same rules.
  11. Each Participant shall only win one (1) Prize throughout the Campaign Period, irrespective of the number of entries submitted to the Organizer. 
  12. The decisions made by the Organizer are final, binding and indisputable. Any form of disputes and/or complaints through any kinds of medium will not be entertained.
  13. The Organizer and its appointed agents will notify the selected winner through WhatsApp. The Organizer and/or appointed agent is not responsible if the Participant sets ‘Disappearing Message’ via WhatsApp app whereby the chat and the image disappears within a stipulated time. In the event that the winner could not be contacted within a reasonable timeframe, the Organizer reserves the right to forfeit the Prize against such winner and/or select another winner.
  14. The Organizer retains sole discretion to withhold Prizes without liability if in its view a winner is ineligible, disqualified, the entry is invalid, or a winner does not meet the necessary requirements as set out in these terms and conditions. 
  15. The Organizer reserves the rights to extend the timelines stated under this clause owing to reasons beyond the Organizer’s control. 
  16. Winners must abide by the terms and conditions of the party(ies) arranging and/or providing for all the Prizes and the terms and conditions attached to all the Prizes, if any.

GENERAL TERMS AND CONDITIONS

  1. The Organizer, all its promotion partners and other parties involved in the Campaign, including their directors, officers and agents are not liable in any way for the following: (a) intervention by unauthorized parties during the Campaign; (b) any human errors and electronic/technical failure in the administration of the Campaign and processing of entries; (c) any entry that is lost, damaged, wrongly delivered or not received; and (d) any liability (including death) whether directly or indirectly caused by their participation in the Campaign and usage of the Prizes.
  2. The Organizer shall not be liable for any default or loss suffered by any party due to natural disaster, war, riot, strike, industrial action, epidemic, pandemic, government restrictions or such other government actions, fire, flood, storm, technical failure or any event that is beyond the reasonable control of the Organizer.
  3. The Organizer at its sole and absolute discretion, reserves the right to reject any entry that is wrong, incomplete, illegally obtained, unclear, damaged, torn, soiled, late, with wrong or insufficient Proof of Purchase. Any entry containing elements of allegations or defamation, involving the misrepresentation, infringing (or may be infringing) any copyright, trademark, or any intellectual property rights or proprietary rights of any entity, both for survival and for the deceased (including privacy rights, publicity, or fraudulent images) will be disqualified automatically.
  4. The Organizer reserves the right, at its sole discretion, to alter, reject or disqualify, without limitation, any entry with element of violation of the Health Ministry's Code of Ethics in Marketing Infant Food and Related Products.
  5. The Organizer reserves the right, at its sole discretion, to provide an alternative item of an equivalent value without prior notice. Any representations and warranties including but not limited to quality assurance, trade or eligibility of the Prizes are exempted from the Organizer.
    The Participant is responsible for all risks, liabilities, damages, or claims caused by the use of the Prizes or by his/her participation in this Campaign. All expenses incurred to participate in this Campaign are the sole responsibility of the Participant.
  6. By participating and/or accepting and/or using any of the Prize(s), the Participant agrees to release liability of the Organizer, all its business partners and other parties relating to this Campaign, including their directors, officers, employees and agents from any claim, prosecution, judgment, damage, or loss.
  7. To the maximum extent permitted by law, the Participant agrees to waive any right against the Organizer and/or officers, employees, representatives and/or designated agents (including suppliers or any third party) in respect of loss or damage arising from the use of the Prize or from the participation in this Campaign. 
  8. By participating in this Campaign, the Participant agrees and has given the Organizer the rights to use his/her name, address, photograph, particulars, documents and information for the purpose of advertising and all other forms of publicity from time to time without any royalty or compensation including, without limitation to any taping(s) and recording(s) in connection with the Campaign.
  9. All entry forms and Proof of Purchases submitted for the Campaign will be the property of the Organizer. 
  10.  Processing of Personal Data.
    a) By participating in this Campaign, each Participant consents to the Organizer’s collection, use and processing of the personal data provided by the participant, which includes Participant’s name, NRIC, address, email address, contact details, and any information which may identify the Participant (collectively, “Personal Data”) for the purposes relating to the Campaign as specified in these terms and conditions (“Purpose”).
    b) The Organizer may transfer personal information (including but not limited to, name, address, contact numbers, IC numbers) to service provider(s) for the purposes of administering the Campaign and contacting Participants, solely for this Campaign only. The Participant has the right to obtain access, request correction or withdraw consent to disclose any personal information held by the Organizer. Such requests can be made via email to the Organizer at privacy.my@danone.com.     c) Please note that it will be necessary for the Organizer to process the Personal Data for the Purpose, without which the Organizers may not be able to accept and/or process the Participant’s entry.
  11. The Organizer may at its sole and absolute discretion amend the Terms and Conditions with the notification on https://www.aptamilkid.com.my, or in any other manner. 
  12. The Organizer reserves the right to modify, cancel, terminate, or suspend this Campaign with the notification on https://www.aptamilkid.com.my , or in any other manner. The Participant shall not make any claim or compensation from the Organizer for any losses incurred
